Sub: Anomaly in fixation of pay of CLIs appointed prior to 01.01.2016 with reference to their juniors

appointed after 01.01.2016 and drawing more pay than the seniors

The letter under reference, circulated by the Railway Board, regarding stepping-up of Sr. CLIs who are getting lesser pay as compared to that of Jr. CLIs promoted later, is totally against the decision passed by the Hon’ble Delhi High Court in C.M. No.4471/2012 dated 05.09.2017 in the matter of Surinder Kumar Dingra Versus Union of India and Others and Hon’ble Supreme Court’s judgement in SLP No.14746/2018 dated 17.07.2018.

Hon’ble Court has taken only seniority as criteria, keeping all the conditions aside, like their feeding channel etc., but the above letter of the Railway Board has laid down certain conditions which can never be fulfilled. The CLIs promoted 20 years back from Loco Pilot(Goods)/Loco Pilot(Passenger) and the CLI promoted today from Loco Pilot(Mail/Express) will definitely draw less pay, even the CLI promoted today had worked as Asstt. Loco Pilot with the CLI promoted 20 years back.

This is a grave injustice to the seniors who have joined Railways earlier, promoted as Loco Pilot earlier and promoted as CLI earlier. The genuineness of the subject matter has not been taken in true spirit. It is the legitimate/fundamental right of a senior employee to draw pay at par with/more than his junior.

AIRF is of considered opinion that, there should be only two conditions for awarding stepping-up to bestow justice to Sr. CLIs – (i) CLIs who were promoted as Loco Pilot earlier, (ii) CLIs who were promoted as Chief Loco Inspector earlier, and if these two conditions are applied, Senior eligible CLIs will be bestowed justice by granting equal/more pay than the Junior CLIs promoted later.
