Sub: Denial of compassionate appointment to ward of staff expired in service
The issue of Compassionate Ground Appointment to Shri Bhagwat, S/o Late Ramchandra Harchand, Ex. Keyman, SSE(P. Way)/BSL Yard(CR), was taken-up by our affiliate – National Railway Mazdoor Union in their GM PNM vide Item No.22/2015, with the Central Railway Administration, but the same had been regretted by the Central Railway further to a clarification sought from the Railway Board and responded by the Railway Board vide letter dated 16.09.2015.
The matter of contention is that, the deceased employee has married to his wife without ascertaining her earlier marital status. She is being considered as nominee of the deceased staff in all service records and availed benefits and privileges of the wife, and as widow, including settlement and pensionary benefits, except legitimate demand of Compassionate Ground Appointment of their son.
Clarification given by the Railway Board vide letter dated 16.09.2015 is based on mis-judgment of the facts and hence the matter needs fresh review.
Relevant documents in connection with this case are also enclosed herewith.
The Board are requested to communicate necessary sanction to Central Railway Administration to provide Compassionate Ground Appointment to Shri Bhagwat, keeping view the facts of the case.
