Sub: Revision of pension w.e.f. 01.01.2006 of pre-2006 pensioners who retired from 5th CPC scale of
Rs.6500-10500 or equivalent pay scale
Ref.(i) MoF(DoE)’s O.M. No.1/1/2008-IC dated 13.11.2009
(ii) DoP&PW’s O.Ms. No.38/33/12-P&PW(A) dated 04.01.2019 and 09.07.2019

Ministry of Finance(Deptt. of Exp.), vide Office Memorandum dated 13.11.2009 decided that the posts which were in pre-revised scale of Rs.6500-10500 as on 01.01.2006 and which were granted normal replacement pay structure of GP Rs.4200 in PB-II will be granted GP Rs.4600 in PB-II corresponding to pre-revised scale of Rs.7450-11500 w.e.f. 01.01.2006. Further, in terms of aforementioned provisions of CCS(RP) Rules, 2008, in case a post already existed in pre-revised scale of Rs.7450-11500, the post being upgraded from scale of Rs.6500-10500 should be merged with the post in scale of Rs.7450-11500.

DoP&PW vide O.M. dated 04.01.2019 issued instructions to revise pension of pre-2006 pensioners who retired from pay scale Rs.6500-10500 to Rs.8345 instead of Rs.8145 giving benefit of GP Rs.4600. Accordingly, revised Concordance Tables No.24 and 25 were issued vide O.M. dated 09.07.2019.

Since all the posts in pre-revised scale of Rs.6500-10500 were merged with the posts in scale of Rs.7450-11500 as per MoF’s O.M. dated 13.11.2009, hence minimum pension of staff in pre-revised scale of Rs.6500-10500 should be 50% of minimum of Rs.7450-11500 pay scale, i.e. corresponding to GP Rs.4600.

Keeping in view above situation, minimum pension as per DoP&PW’s O.M. dated 28.01.2013 should be Rs.932 w.e.f. 01.01.2006 and Rs.23800 w.e.f. 01.01.2016.

The issue needs to be reconsidered in the light of various court judgements and revision of pension of staff retired in Rs.6500-10500 pre-revised scale should be fixed at 50% of Rs.7450-11500 as pay scale Rs.6500-10500 was non-existent and upgraded and merged in Rs.7450-11500.

AIRF requests to issue necessary orders fixing pension @ Rs.9230 w.e.f. 01.01.2006 and Rs.28300 w.e.f. 01.01.2016 for all employees retired in pay scale Rs.6500-10500 at the earliest.
