Reference above, it is stated that, contention of the Railway Board, that, Board’s letter No.E(P&A)II-98/BDA-1 dated 25.09.1999 is superseded by their letter No.E(P&A)-2007/FE-4/3 dated 25.09.2009, is not correct, therefore, not acceptable to us. In this connection, we quote below para 2 of Railway Board’s letter dated 25.09.1999, which reads as under:-
“All other non-gazetted staff of all departments who are called out in connection with accidents/breakdowns, including the Supervisory staff who are not eligible for Breakdown Allowance, shall be allowed the concessions enumerated in Clauses (iii), (iv) & (v) of Sub-Rule (1) above”.

Reference above, it is stated that, contention of the Railway Board, that, Board’s letter No.E(P&A)II-98/BDA-1 dated 25.09.1999 is superseded by their letter No.E(P&A)-2007/FE-4/3 dated 25.09.2009, is not correct, therefore, not acceptable to us. According to said para, all the Supervisors working in Breakdown duty not as in-charge but as Supporting Staff to in-charge, are exempted from “Supervisory” classification and are entitled for Breakdown Allowance.
Reference made by South Central Railway Administration, vide their letter No.P(R) 64/VI/Pilot dated 10.02.2010, also sought clarification on these lines, therefore, the matter should be re-examined, and necessary clarification be issued to South Central Railway administration accordingly with a copy to other Zonal Railways.
An early action in the matter shall be highly appreciated.
